UM, THE EDA HAS BEEN BEEN A BIG CHALLENGE.

I WAS REQUESTING THIS FOR THE LAST TWO WEEKS VIA EMAIL, UM, COPYING OUR, OUR, UH, GRANT ADMINISTRATOR AND TRYING TO GET SOME MORE INFORMATION.

UM, WAS TOLD I WOULD GET AN UPDATE, A COMPREHENSIVE UPDATE LAST FRIDAY.

I HAVE NOT, UH, RECEIVED THAT.

HOWEVER, WE DID RECEIVE APPROXIMATELY $1.3 MILLION ON MONDAY.

UM, SO THAT'S AT LEAST A START.

UM, SO WE'RE, YOU KNOW, WE'RE GONNA CONTINUE TO WORK, UM, WITH THE EDA WITH OUR GRANT ADMINISTRATORS, MAKING SURE THAT WE GET, WE, WE RECAPTURE THAT FULL $3 MILLION REIMBURSEMENT.

UM, SO, UH, FOR YOUR NEW BOARD MEMBERS, JUST TO MAKE SURE EVERYBODY IS AWARE, WE DID HAVE TO ACCELERATE THAT PROJECT.

MOST OF THAT WAS, WAS FOR THE 2026 BUDGET.

WE HAD TO DO A BUDGET AMENDMENT IN DECEMBER.

'CAUSE WE, WE WALKED INTO A MEETING IN JULY AND THEY SAID, OH, YOU NEED TO HAVE EVERYTHING INTO US BY DECEMBER.

SO INSTEAD OF AN OCTOBER CONSTRUCTION START DATE, WE ENDED UP WITH A AUGUST 1ST CONSTRUCTION OR AN AUGUST CONSTRUCTION START DATE.

UM, SO, UH, LIKE I SAID, CONTINUES TO PROGRESS NICELY.

UM, OUR NEXT ITEM, WE DO HAVE ONE, UM, CHALLENGE.

UM, SO WE DO HAVE, UH, DO I HAVE MEMBERS OF TERRACON HERE? OKAY.

UM, SO, UM, IN THAT PROJECT, OBVIOUSLY THE, THE OWNER NEEDS TO CONTRACT SEPARATELY WITH THE MATERIALS TESTING FIRM.

UM, THE CITY HAS A CURRENT CONTRACT WITH TERRACON.

WE, WE CONTRACTED WITH TERRACON.

UM, THE ORIGINAL MO ORIGINAL AGREEMENT FOR SERVICES HAD A FEE ESTIMATE OF $49,960.

UM, WITH THAT BEING A, A TIME AND MATERIALS BUDGET ESTIMATE, UH, AND A NOT TO EXCEED PRICE.

NOW, UM, I I DO WANT TO POINT OUT IN IN, IN FAIRNESS TO THE GENTLEMAN HERE TODAY, UM, THE ORIGINAL BID FROM TERRACON WAS, WAS AROUND 59,000.

AND I CALLED THEM UP AND I SAID, HEY, YOU KNOW, THIS IS A PARKING GARAGE.

HERE'S WHAT I BUDGET, I BUDGETED 50.

UM, THE PROJECT, AS MANY OF YOU ARE PROBABLY AWARE, WAS, WAS ALREADY WELL OVER BUDGET AND WE WERE ADJUSTING THAT.

UM, SO THEY CAME DOWN FROM 59 TO THE 49 9.

UM, SO THE ORIGINAL FEE ESTIMATE, UH, AS EXPLAINED TO ME, AND UH, I'M SURE THE REPRESENTATIVES CAN TALK A LITTLE BIT MORE, UM, HAS BEEN EXCEEDED WITH SOME REMAINING CONCRETE AND STEEL WORK LEFT TO BE TESTED.

UM, REASONS PROVIDED FOR TERRACON, UH, OR FROM BY TERRACON FOR THE OVERAGES.

AND, AND GENTLEMEN, IF YOU WANNA COME UP TO THE PODIUM, 'CAUSE I'M SURE THERE'LL PROBABLY BE SOME, SOME FOLLOW QUESTIONS TO THIS, UM, UM, WAS ATTRIBUTED TO TERRACON BEING REQUESTED TO MAKE MORE TRIPS TO SITE FOR EARTHWORK TESTING THAN WAS ORIGINALLY BUDGETED.

I WANT TO SAY ORIGINALLY WHENEVER WE BID THE PROJECT, WE WERE SUPPOSED TO MAKE AROUND 16 TRIPS, MORE OR LESS TO COMPLETE EVERYTHING.

UM, BUT AS TO DATE, AND THIS WAS PROBABLY A LITTLE EARLIER BEFORE WE'VE MADE 41 TRIPS TO THE SITE, UM, AS REQUESTED.

SO KIND OF TO DELVE INTO THAT, WE ARE, UM, SCHEDULED ON AN AS REQUESTED BASIS.

SO WHENEVER THE CONTRACTOR COMES DOWN AND TELLS US, HEY, WE NEED SOMETHING TO BE TESTED, THAT'S WHEN WE SHOW UP AND WE STAY HOWEVER LONG THEY NEED US TO, TO FINISH THAT TESTING, WHETHER IT BE, ESPECIALLY FOR, FOR STUFF LIKE EARTH WORK.

SO, JUST TO GIVE A LITTLE BIT OF CONTEXT, THAT ORIGINAL BUDGET WAS ABOUT 15,000.

CURRENTLY IN SERVICES WE'RE AT 30 PERFORMED FOR EARTH WORK TESTING.

SO THAT'S MORE OR LESS WHERE A LOT OF THE OVERAGES HAVE COME FROM AS FAR AS JUST BEING SCHEDULED OUT THERE TO PERFORM MORE TESTING THAN WAS ORIGINALLY BUDGETED.

AND SO WHO'S, WHO'S REQUESTING YOU GUYS TO MAKE THESE TRIPS? IS IT, IS IT THE CITY OR IS IT, IS IT, IS THAT THROUGH THE CONTRACTOR THAT'S BUILDING THE PARKING GARAGE? THAT'S THROUGH F FLINTCO.

AND WHEN I ASKED F FLINTCO ABOUT IT, THAT WAS DUE TO, UM, THEIR EX EXPEDITING OF THE PROJECT.

SO NOR, YOU KNOW, NORMAL COURSE WITH, WITH TIME NOT BEING, UH, YOU KNOW, ON A NORMAL CONSTRUCTION SCHEDULE, AT LEAST YOU KNOW WHAT THEY'RE TELLING ME.

UM, WHICH IS, WHICH IS FAIRLY TRUE.

THEY'RE GONNA HAVE SEVERAL ELEMENTS, RIGHT.

SO WHEN YOU'RE TALKING ABOUT A, A TRIP TO THE SITE, YOU'RE NOT NECESSARILY COMING FOR ONE THING, RIGHT.

YOU'RE COMING AND YOU'RE TESTING MULTIPLE THINGS, RIGHT.

AND WITH THEM, THEY WERE CALLING YOU GUYS, THEY WERE CALLING THEM TO COME OUT BECAUSE THEY WERE MOVING VERY QUICKLY.

UM, SO THEY WERE LIKE, HEY, WE'VE DONE THIS, WE NEED THIS TESTED RIGHT? AND THEN TOMORROW THEY WERE DOING SOMETHING ELSE, HEY, COME OUT, WE NEED TO DO, WE NEED TO HAVE THIS TESTED.

UM, 'CAUSE OBVIOUSLY, YOU KNOW, WITH THE, UM, THE ONLY DELAY IN THE PROJECT OR, OR, OR THING THAT I HAD IDENTIFIED JUST IN LOOKING AT THIS WAS, YOU KNOW, WE FOUND THAT BURN PIP THAT WAS UNDERGROUND.

OBVIOUSLY THAT WAS ADDITIONAL TRIPS OUT, RIGHT? UM, BUT YOU KNOW, THERE'S MORE TO THIS CHANGE ORDER.

'CAUSE IF, IF YOU THINK ABOUT IT, THAT CHANGE ORDER FROM THE CONTRACTOR FOR THAT WAS ONLY 20,000.

RIGHT? SO THAT'S, THIS 12,003 IS NOT JUST FROM THAT PARTICULAR, UM, SITUATION.

SO, UM, WAS THE, IS THE EXPEDITED, UM, SCHEDULE OUR REQUEST, THE CITY'S REQUEST OR, SO THE EXPEDITED SCHEDULE WAS TO, UM, UH, WAS WAS TO MAKE SURE THAT WE CAPTURED ALL OF THE $3 MILLION IN GRANT MONEY, RIGHT? SO, SO IT WAS, UM, YOU KNOW, WE COULD HAVE STUCK WITH OUR SCHEDULE, BUT WE PRO HONESTLY, WE PROBABLY WOULD'VE CAPTURED MAYBE HALF OF THE GRANT MONEY.

UM, SO WE WENT INTO, YOU KNOW, SO MY DIRECTION TO F FLINTCO WAS, YOU KNOW, WE SAT AND DEVELOPED A SCHEDULE AND A PLAN TO GET FAR ENOUGH ALONG, UM, BY DECEMBER 1ST, WHICH WAS THE LAST DAY WE COULD, WE COULD SUBMIT, UM, PAYABLE OR REIMBURSEMENT REQUESTS INTO THE EDA THAT WE HAD ENOUGH DONE TO GET THAT DONE.

AND WHEN YOU THINK ABOUT IT, IT'S NOT JUST $3 MILLION OF THE 5.3 MILLION CONSTRUCTION BECAUSE THE RE THE GRANT REIMBURSE AT EACH PAYMENT, 66%.

SO, YOU KNOW, WE, IT, IT WAS A SIGNIFICANT, UH, EFFORT TO, TO TRY TO GET TO THAT POINT SO THAT WE COULD RECAPTURE, UM, ONCE THAT WAS HIT, THINGS, YOU KNOW, SLOWED DOWN TO SORT OF NORMAL NORMAL PACE.

SO LET ME, LET ME JUST REPEAT BACK WHAT I THINK I HEARD AND SEE IF I I'VE GOT IT.

SO, SO WHEN THEY, WHEN THEY DID THE ORIGINAL, UM, WHEN THEY DID THE ORIGINAL ESTIMATE THAT CAME UP WITH THE FIXED FEE, UH, PRICE, THEY HAD IN MIND, UM, A CERTAIN SCOPE OF TESTING THAT WOULD HAVE TO BE DONE.

AND PART OF THE WAY THEY PRICED IT WAS THAT IT WAS GONNA BE BASED ON NUMBER OF TRIPS.

SO IT SOUNDS LIKE TWO THINGS HAPPENED, IF I UNDERSTAND IT WELL, ONE IS, IS THE, IS THE, IS THE, THE STUFF THAT THEY FOUND, UM, YEAH, SO, SO, SO THAT WAS ONE THING.

THERE WAS EXTRA TESTING THAT HAD TO BE DONE THAT WASN'T SCOPED.

THAT RIGHT.

THERE WAS, I MEAN THAT'S THREE OR FOUR EXTRA TRIPS RIGHT THERE.

AND THEN TWO IS, UM, GENERALLY THEY WOULD HAVE THEM COME OUT ONE TIME AND DO SEVERAL THINGS.

LIKE THEY'D KIND OF BUNDLE IT, BUT BECAUSE OF THE SPACE THEY WERE MOVING, THEY DID IT SERIALLY, WHICH JUST CREATED MORE TRIPS WHICH CREATED ADDITIONAL COSTS.

IS THAT ALL THAT THAT IS MY UNDERSTANDING IS THAT, THAT, YES, SIR.

AND I WOULD, I WOULD LIKE TO JUST POINT OUT, UM, SO THE CONTRACT THAT WE SENT OVER, IT'S NOT REALLY A FIXED PRICE.

OUR, OUR CONTRACTS ARE MOSTLY FOR MATERIAL SERVICES, THEIR TIME AND MATERIALS, HOWEVER MANY TIMES WE GET CALLED OUT THERE AND HOW MUCH TIME WE'RE ON SITE.

SO IT'S NOT EXACTLY A FIXED PRICE IN THE CONTRACT.

IT DOES SAY THIS IS A COST ESTIMATE BUDGET AND NOT A, NOT TO EXCEED PRICE.
